After the ground-breaking ruling passed by the Spanish Supreme Court in 2015, customers were refunded 40,000 euros and awarded timeshare terminations – following timeshares being mis-sold.
This ruling along with other significant judgments have resulted in customers being eligible for timeshare terminations and claims against resorts such as Club La Costa under the subsequent conditions:
In recent months there has been a ground-breaking ruling against Club La Costa wherein a client was awarded a complete reimbursement of the buying cost along with a proportion of maintenance fees, his agreement was cancelled and he was granted a timeshare release.

Fawlty Towers
This was a Private Rental which I didn’t realise at the time of booking for my family.
Benal Beach is a fantastic complex, a bit run down in need of some TLC.
The pool área is amazeing, great for my 12 year old grandson.
The Studio on Block 2 5th floor room 517,i do not advise anyone to go there.
This was a 2 night break away for my family,i wouldn’t want my cat’s staying there never mind my kids,
Toilet a total DISASTER, vent in toilet broken, toilet roll stuffed in vents to prevent crawlies coming through.
Toilet roll holder broken, shower curtain all Brown at bottom caused by wáter horrible.
Toilet cabinet with supposed lights at top,…..NO LIGHT FITTING ALL BROKEN.
The one and only thing ok in this Studio is the bed which was clean thank god.
Faulty light fittings hanging out the Wall, blankets to be found in top box which were totally disgusting and smelly, not been washed for Winter.
The keys didn’t arrive till over 1hour of check-in time, which time was valuable to my family for a 2 day break away.
The owner of this Studio who I know is Spanish, should be ashamed of himself for letting this property out and not updating it for year’s, too busy taking the cash….DISGUSTING.

CSV Benal Beach
To start with this is a privately owned apartment in Benal Beach Complex. Upon arrival we waited until 5pm until someone came to let us into the apartment, signed a form and quickly left with €100 deposit. We had booked a sea view apartment but got a basement apt with a view of a wall. The air con was leaking onto the double bed which was in fact a fold away camper bed. There was water everywhere. This was fixed the next morning by placing a hose in a 8 litre water bottle which we had to empty every day. The apt needed a good clean. We didn’t spend too much time in the apartment as we didn’t feel comfortable in it. When we left, we were told to leave the keys on the table and that our deposit would be given back to us through bank transfer. After many phone calls and texts, We still haven’t received our deposit back 2 months later.
I’m sure Benal Beach itself is fine but don’t book a private apartment there.
Worst place I have ever stayed
My sister organised my hen party! My sister did a fabulous job but the apartment we stayed in was shocking!
The apartment was old fashioned but we didn’t mind that as it was a place to sleep
We turned on the air con and it began to leak. We spoke to reception and they sent someone to fix it. We left for the day on return the living room looked like a swimming pool plus the pull out bed was soaking’ My friend spoke to reception again but she was told it’s not their issue
It was down to the air con manufacturer to sort the issue. He gave my friend the number for the air con manufacturer and told her to deal with it.
She then asked for another apartment but he refused.
We did not let this ruin our weekend so we used a bin to catch the waterfall now coming out the air con
We would of turned it off but it was so hot we needed it.
We went down to the pool. When we arrived they refused us entry as we did not have a pass. We went back to reception to get our passes (we should of had these on arrival)
Our last day we got up at 10am and rushed around to get packed to leave (we were not given a time to leave by) at 10.15am the cleaner knocked the door and started shouting at us. We told we would be 5mins – She then knocked the door a minute later shouting more abuse. We left the room 5mins later
We were a hen party but we were quiet and respectful when around the apartment, so I do not understand why all the staff were so rude
I will never recommend going to Benal Beach complex
Awful place!!
We went to Benal Beach in Benalmadena with a child at the age of two. The pool bar plays loud music until 2100-2300 which seemed up the building and into the apartment.
The pool is extremely crowded and has a “pool party” feeling, meaning that guest get quite drunk during the day.
Sadly the kids pool was sealed of, for no apparent reason, so small children swam along side adults/young adults partying.
Guests threw lit cigarettes in the grass next to small children eating ice cream, and the entire pool area was quite dirty and had garbage laying around.
One day, five armed police officers came to calm a group down. The same day a grown man vomited in the pool.
Do not go to Benal Beach unless it is for the cheap pool bar and pool party.
NOT A PLACE FOR FAMILIES!!!
Awful !!!!
I’ll start with the pros: good location, close to the beach, pool cafe handy and good for snacks, nice pools and pool bar.
Con’s: unhelpful reception that gives wrong info, if unfortunate enough to get room 310 in block 4 don’t bother checking in!
No air con, dirty, dark and looks like it’s never been redecorated since the 1970’s, you have to rent air con from reception but they will tell you to go to the holiday rep (lots of different companies own the apartments) then the holiday rep tells you to go to reception!
We originally booked CLC Benal Beach but Travel republic changed it 5 days before we were flying out. Had no choice but to stay here. My sister had a CLC apartment and it was lovely, in the end we had to crash in her apartment because ours was so bad and everything else booked up. With 2 kids there was no way we could stay in the apartment due to the air con unit’s vent had to go outside so this meant the patio door being left open all the time so for safety, noise and not being able to pull out the sofa bed we had no choice but to cram us all into my sister’s apartment. Plus in bedroom only one plug socket behind the headboard so had to move the bed base to plug in fan.
Cleaners are the best, cleaning consisted of emptying bins and giving fresh towels, that’s it!!!! And this is whilst we happen to be in the room so saw with our own eyes.
There are some really nice rooms in the complex, unfortunately, ours was not one of them.
Disappointingly bad hotel
We booked Benal Beach specifically because it was right next to the beach – even checking on Google Earth. What we hadn’t reckoned on was the gate to the beach being padlocked closed, so that actually you have to walk from the front entrance, through the jam-packed car park and around a whole block of other buildings. Also what we really needed to avoid was the uphill walk back due to a health condition – this was a nightmare twice a day for us. There are side gates, but as renters we weren’t given access to any of those gates.
As some other reviewers have said, the reception staff do not speak English and are rude. After trying to get directions to the office to reigister put passports on a number of occasions we gave up. This meant we couldn’t access the pool facilities other than on the first day.
The apartment itself was basic with a lot of lights not working. There was no air conditioning, just a ceiling fan which was useless.
The walls are really thin so on most nights we had to endure the screeching sex noises of the woman in the next apartment along with the banging furniture – so bad that once in the bathroom I thought they were going to break through the wall and join me! You might say “Each to their own” or “well they’re on holiday too”. Well yes, but they werent having to sit through this noise with their thirteen year old daughter!!
The beds were the worst we’ve ever endured – and the pillows too. And the bed linen only gets changed every 7 days – which is delightful when the temperatures were in the 30C range!
The hotel has a huge problem with feral kids running wild in the corridors throughout the days and nights – and they do nothing about it. So our daughter had to endure being whistled at and having rude comments. The kids jam the lifts, leave rubbish everywhere and just run wild – shrieking at people as they walk past.
A word about the hotel bar – on Friday, Saturday and Sunday they have live(ish) music for Spanish people to come and dance. The dancing is actually lovely – attracts a lot of older Spanish people and some of them are great dancers. The live (sort of) music is a backing track played along to by a guitarist and because of this the bar has a minimum per-drink charge of €4 – even for a small bottle of water.
The website images don’t represent the actual complex at all – so disappointing and even more disappointing to see so many other poor reviews and a complete lack of interest from the owners.
Hated the apartment at Benal Beach
I have just returned from Benalmadena Costa and hated every minute of it. The apartment was very basic with the loo wobbling and the washbasin loose. The balcony floor was unfinished and rough with holes in it and the walls were paper thin. In the end I paid extra to move to another one in the Jupiter block which was a bit better but very small and with only a sofa bed and no proper table and chairs – only the ones on the small balcony. It was, however, infinitely better than the first one. The resort was just like battery hens – all blocks and no soul – and the joys of ‘Spain’ were nowhere to be seen. Blackpool with the sun as there were more British owned bars, restaurants, etc. than there are in England. Altogether a very disappointing experience. The only bright spot of the week was the trip on the bus to Benalmadena Pueblo – a joy and just how Spain should be, or as it was in years gone by. Tourism has ruined Spain – on the coasts at least and I will not be in a hurry to go back.
On my last night I treated myself to a meal in the only Spanish restaurant in the area and was ripped off by the waiter who recommended the sea bass ( after I asked for sardines) and I bowed to his better judgement only to find when the bill arrived that that was the most expensive item on the menu. I complained to the management who did pass on my comments to the waiter but did not even suggest a rebate. So I left with a very bad taste in my mouth – and the fish was not all that tasty either.
